1. General
These Terms of Service ("Terms") govern the use of Joy Yachting's website and yacht charter services. By making a booking or using our services, you agree to be bound by these Terms. Joy Yachting acts as a charter broker, facilitating agreements between clients ("Charterer") and yacht owners.
2. Booking and Reservation
- A booking is confirmed upon receipt of a signed charter agreement and payment of the required deposit.
- A deposit of 50% of the total charter fee is required to secure your booking.
- The remaining balance is due no later than 30 days before the charter start date.
- For bookings made within 30 days of departure, full payment is required at the time of booking.
- Interest-free instalment plans (pay in 3) are available through Klarna, subject to Klarna's terms and approval.
3. Charter Prices and Inclusions
Charter prices include:
- Yacht hire for the agreed charter period.
- Professional captain and crew (where applicable).
- Standard yacht insurance.
- Bed linen, towels, and basic amenities.
Unless otherwise stated, prices do not include:
- Fuel and marina/port fees.
- Food, beverages, and provisioning.
- Water sports equipment rental.
- Gratuities for the crew.
- Travel insurance (strongly recommended).
- Airport transfers and shore excursions.
4. Cancellation Policy
- 60+ days before departure: Full refund minus a 10% administrative fee.
- 30–59 days before departure: 50% of the total charter fee is retained.
- Less than 30 days before departure: No refund is available.
- We strongly recommend purchasing travel insurance that covers cancellation.
- In the event Joy Yachting cancels the charter (e.g., due to yacht unavailability), a full refund or an equivalent alternative yacht will be offered.
5. Security Deposit
A refundable security deposit may be required before boarding, as specified in the charter agreement. The deposit covers potential damages to the yacht beyond normal wear and tear. The deposit is returned within 7 business days after the charter, subject to a satisfactory yacht inspection.
6. Guest Responsibilities
- The Charterer must provide a complete guest list with valid passport or ID details prior to the charter.
- Guests must follow the captain's instructions at all times for safety.
- The Charterer is responsible for any damage caused by guests to the yacht or its equipment beyond normal wear and tear.
- Illegal substances and activities are strictly prohibited on board.
- The maximum number of guests must not exceed the yacht's certified capacity.
7. Weather and Force Majeure
The captain has sole authority over navigation and itinerary decisions based on weather and sea conditions. Route changes due to weather do not constitute grounds for a refund. In cases of force majeure (natural disasters, government restrictions, pandemics), Joy Yachting will work with the Charterer to reschedule or provide credit for a future charter.
8. Liability
Joy Yachting acts as a broker and is not the owner or operator of charter yachts. While we carefully vet all yachts and operators, Joy Yachting's liability is limited to the charter fee paid. We are not liable for personal injury, loss of property, or consequential damages arising from the charter, except where caused by our gross negligence. All yachts carry third-party liability insurance as required by maritime law.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Bodrum, Mugla, Turkey.
10. Changes to Terms
Joy Yachting reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services constitutes acceptance of the revised Terms.
